Why financing differs from one state to the next

This is not a quirk of one company. It is how consumer finance law works in the United States, and it is worth understanding before you apply.

Two different bodies of law

A loan is governed by federal credit law and by each state's lending statutes. A lease-purchase agreement is governed by that state's rental-purchase statute instead, which is a different rulebook with different disclosures, different fee limits and different rights to reinstate after a missed payment.

Licensing is per state

Lenders and lessors choose which states to license in. A provider that is a perfect fit for your credit profile may simply not operate where you live — Snap Finance, for example, does not offer its lease-to-own agreements in Minnesota, New Jersey or Wisconsin.

Some categories are restricted

Certain goods carry rules of their own. Several states restrict or prohibit lease-purchase agreements covering live animals, which is why pet financing availability is confirmed during the application rather than promised in advance.

What this means for you in practice

Do not assume a product you read about is available where you live, and do not assume a decline in one state would have been a decline in another. The application checks your state against every provider in the network at the moment you submit, which is more reliable than any page can be.

How old do I have to be to apply?

Old enough to enter a binding contract where you live. That is 18 in most states, 19 in Alabama and Nebraska, and 21 in Mississippi. Some individual providers set their own higher minimum on top of the state rule.

I moved recently — which state counts?

Your current state of residence, which is the address on your application and your identification. If your ID still shows your old state, expect to be asked for proof of your current address before an offer is finalised.

Can I apply in one state and take delivery in another?

Sometimes, but it complicates things: the agreement follows the law of your state of residence while the merchant and delivery follow another. Tell customer care before you apply so the file is routed correctly rather than unwound afterwards.

Does my state affect the rate I am offered?

It can. State law caps certain fees and charges, and it determines which providers can compete for your file at all. Two applicants with identical credit in different states can see genuinely different offers.
